Terms & Conditions

All measurements indicated are approximate.  Item descriptions are for use as guide and do not form part of any contract. Colours differ due to variations of the monitor on which the item is viewed and should be used for guidance only. 

 

2. RESTRICTED ITEMS / RESTRICTED DELIVERY

All such items are clearly marked.  Orders placed that cannot be fulfilled due to restrictions will be cancelled and refunded.

3. PAYMENT

We accept payment, via a secure server, by major credit and debit cards and also by PayPal account.  All payments are processed through PAYPAL and their terms and conditions apply to all transactions.

Shamrock and Heather does not have access to the credit or debit card information that you enter on the PAYPAL secure pages.

The currency converter on our website is for guidance only and amounts shown in currencies other than UK POUNDS may be subject to variation at time of exchange.

 

4. SHIPPING/DELIVERY
Prices shown on or website are inclusive of postage and packing and no additional shipping/delivery charges are added to your order at checkout.

Orders for stock items are normally processed and shipped within 1 – 5 working days.  Made to order items are normally shipped within the guide time indicated.  It is unusual for a shipping delay to occur but if any such delay does occur you will be notified by email.

Orders destined for delivery within the UK are normally sent by Royal Mail or Parcelforce.  Orders destined for delivery within the EU and WORLDWIDE are normally despatched by Royal Mail Airmail with the exception of books that are normally sent by Surface Mail.  An indication of time in transit after despatch can be found at www.royalmail.com

All orders are shipped with a basic invoice/delivery note to the delivery address supplied by the customer. Any additional invoice required may be posted or emailed at our option.

5. TAXES
Shamrock and Heather do not accept responsibility of any kind for the payment of duties, taxes and/or fees of any description, or for any reason, due to the authorities of any country, without exception, that may be applied to or associated with orders that have been shipped outwith the UK.  Neither do we accept responsibility for import taxes to the UK for returned goods that are not clearly marked as such.  In the event that any such payment is due to the authorities the purchaser is liable for the payment.  

 

6. RETURNS / CANCELLATION

You may return your order for any reason (with the exception of earrings, in the interest of hygiene, and non stock items that are made to order) in their original new and unused condition and packaging. You will be liable for the cost of return postage associated with the order. You must notify us, by email, of your intention to return the goods within 7 working days of receipt. Shamrock and Heather will contact you by email within 2 working days of receiving your notification and supply you with the information you will require to return the goods and any time limit applied.  In the event that you return goods it is your responsibility to ensure that the carrier you use to return the goods will compensate you for any damages/losses caused during transit as we cannot accept responsibility for and/or give a refund for goods damaged or lost in transit.

You may cancel your order for any reason (with the exception of earrings, in the interest of hygiene, and non stock goods that are made to order) up to 7 working days after the receipt of the order.  If your order has been despatched prior to cancellation the same conditions and costs for returned orders will apply.  If you cancel your order prior to despatch you will receive a refund equivalent to the full cost paid by you.

You have a duty to care for the item being returned and to ensure that it has not been used or tampered with in any way.  You must contact us by email and notify us of your intention to cancel your order.  Shamrock and Heather will normally reply to your email within 2 working days and inform you of the status of your order and, if appropriate, supply you with the information you will require to return your order. All refunds will be made within 30 days provided all conditions are met.

All items being returned from outwith the UK for any reason must be clearly marked RETURNED GOODS  otherwise there may be an import tax liability.

7. DAMAGES/DEFECTS/LOSSES
All goods are first quality and leave our premises in a new and unused condition. You should inspect your goods immediately on receipt.  If there is any sign of damage to packaging you should ensure that the contents are carefully checked for damage and/or loss and, where possible, request a note to this effect from the carrier at the time of delivery. If your order is damaged or missing items you should notify us immediately by email.  We do not accept liability of any kind for any loss or damage to goods caused while in transit nor do we accept liability of any kind for personal injury caused by goods that have been damaged in transit.  Any loss or damage caused in transit is the responsibility of the carrier and you are required to supply us and/or our carrier, on request, with all relevant information to enable us/them to deal with this. Upon us receiving notification that you have received a damaged item we will, if appropriate, supply you with the information you will require to return the item within 2 working days.  We and/or our carrier will investigate the cause of the damage and if our carrier is found to be liable we will replace the damaged item. We will, thereafter, claim any compensation due from our carrier for loss of or damage to goods. We will also, in due course, refund postage costs for the return of damaged goods only if authorised by us prior to posting and only if it is found to be our carrier at fault for the damages.   In the unlikely event that a whole order is lost we shall replace the item or items contained therein, or in the event that replacement items are not available we will refund you for any or all of the items contained therein, only after the period of time that is specified by our carrier that determines when an item is lost in transit has lapsed.     Any other claim of any other description shall be between you and the carrier.

Shamrock and Heather do not accept liability for manufacturing defects or any other defects or any injury caused as a result of a defect.  In the unlikely event that the goods supplied are found to have a defect you should notify us immediately upon receipt of the item by email with all appropriate information to enable this to be dealt with. Manufacturing faults shall be dealt with by the manufacturer and shall be subject to the manufacturers warranty conditions.  Any other claim of any other description, including personal injury proved to be caused by a defect, shall be between you and the manufacturer. 

You are required to exercise the utmost care when unpacking any item (especially glass) as Shamrock and Heather do not accept responsibility or liability for any injury of any description caused by any item that is not wholly manufactured by us.

Shamrock and Heather, carriers, and manufacturers do not accept responsibility for any item that has been damaged at any time after receipt by the customer.

8. STOCK CONTROL

Stock level is updated on this website only after payment has been made. 

9. WARRANTY
All merchandise sold on this website is covered by guarantee only as per individual manufacturer.

10. DISPUTES
In the event that an unresolvable disagreement arises between the vendor and the purchaser, all disputes will be resolved subject to the terms and conditions as laid down by Scottish Law and, where no agreement can be reached, shall be settled in Scotland within a Scottish Courtroom with the total exclusion of the laws and courtrooms in all other countries.

11. PRIVACY
Any personal details you provide us with to enable us to process your order are for our own use. We do not pass your details to third parties.

12. DISCLAIMER
Shamrock and Heather endeavour to provide accurate information but cannot be held liable for any discrepancies of any kind on this website.
